Re: BREAKING: White House announces 6 'initial' executive actions on gun control
Here it is. Now lets see if any of these big talking so called patriots do anything. They had a golden opportunity at the capital but acted like damn tourists instead.

Until people stand up this will get worse. These are minor really the brace BS has been questionable from day one and the ghost gun shit just effects probably a handful of dumb asses. But if no one or no states stands up now its over.

Everyone should sue SB tactical because they alone have just created a hugh headache for millions. ANd they knew this brace bs was sketchy at best but continued to market these.

No surprise here this has been on the chopping block for years and years. ATF just didnt know how to unfuck themselves from these mistakes. SO he really didnt do much of anything.

1. The Justice Department, within 30 days, will issue a proposed rule to help stop the proliferation of “ghost guns.”

2. The Justice Department, within 60 days, will issue a proposed rule to make clear when a device marketed as a stabilizing brace effectively turns a pistol into a short-barreled rifle subject to the requirements of the National Firearms Act

3. The Justice Department, within 60 days, will publish model “red flag” legislation for states.

4. The Administration is investing in evidence-based community violence interventions

5. The Justice Department will issue an annual report on firearms trafficking.

6. The President will nominate David Chipman to serve as Director of the Bureau of Alcohol, Tobacco, and Firearms.

“The Congress shall have Power to dispose of and make all needful Rules and Regulations respecting the Territory or other Property belonging to the United States, and nothing in this Constitution shall be so construed as to prejudice any claims of the United states, or of any particular State.”

Therefore, all U.S. citizens [i.e. citizens of the District of Columbia] residing in one of the states of the Union, are classified as property and franchisees of the federal government, and as an “individual entity.” See Wheeling Steel Corp. v. Fox 298 U.S. 193, 80 L.Ed. 1143, 56 S.Ct. 773. Under the “Buck Act,” 4 U.S.C Secs. 105-113, the federal government has created a “Federal area” within the boundaries of the several states. This area is similar to any territory that the federal government acquires through purchase, conquest or treaty, thereby imposing federal territorial law upon the people in this “Federal area.” Federal territorial law is evidenced by the Executive Branch’s Admiralty flag (a federal flag with a gold or yellow fringe on it) flying in schools, offices and courtrooms.

All acts of Congress are territorial in nature and can only apply within the territorial jurisdiction of Congress. See American Banana Co. v. United fruit Co., 213 U.S. 347, 356-357 (1909); U.S. v. Spelar, 338 U.S. 217, 222, 94 L.Ed. 3, 70 S.Ct. 402 (1925).

I saw the writing on the wall a long time ago and changed my set up completely. Sold all my ARs and pistol variants, sold ALL my semi auto firearms, and now have a basic 4 gun setup...bolt action hunting rifle .308, a .357 revolver for home protection, an action lever also chambered in .357, and a plinking .22 for practice and small game. All non threatening, and arguably the last firearms that will be targeted.

If I ever needed a military type rifle, for a military type of engagement, i’ll Take one off a dead soldier and use it. Until then, I’m fine with what I have.

Re: BREAKING: White House announces 6 'initial' executive actions on gun control
Supreme Court Justice Louis Brandeis, testimony before the Committee on Interstate Commerce, 1911. (102) “Behind the visible government there is an invisible government upon the throne that owes the people no loyalty and recognizes no responsibility. To destroy this invisible government, to undo the ungodly union between corrupt business and corrupt politics is the task of a statesman

Sovereign individuals are subject only to a Common Law, whose primary purposes are to protect and defend individual rights, and to prevent anyone, whether public official or private person, from violating the rights of other individuals. Within this scheme, Sovereigns are never subject to their own creations, and the constitutional contract is such a creation. To quote the Supreme Court, "No fiction can make a natural born subject." Milvaine v. Coxe's Lessee, 8 U.S. 598 (1808). That is to say, no fiction, be it a government, a corporation, a legislated statute or act, or an administrative regulation, can mutate a natural born Sovereign into someone who is subject to his own creations.

"Every man is supposed to know the law. A party who makes a contract [or enters into a franchise, which is also a contract] with an officer [of the government] without having it reduced to writing is knowingly accessory to a violation of duty on his part. Such a party aids in the violation of the law." [Clark v. United States, 95 U.S. 539 (1877)]

“The idea prevails with some — indeed, it found expression in arguments at the bar — that we have in this country substantially or practically two national governments; one, to be maintained under the Constitution, with all its restrictions; the other to be maintained by Congress outside and independently of that instrument, by exercising such powers as other nations of the earth are accustomed to exercise.” Downes v. Bidwell, 182 U.S. 244, supra.

UNITED STATES CODE Title 28 USC 3002 Section 15 (A) (B) (C)

(15) “United States” means—

(A) a Federal corporation;

(B) an agency, department, commission, board, or other entity of the United States; or

(C) an instrumentality of the United States.

28 U.S. Code § 3002 - Definitions

(10) “Person” includes a natural person (including an individual Indian), a corporation, a partnership, an unincorporated association, a trust, or an estate, or any other public or private entity, including a State or local government or an Indian tribe.

“The United States government is a foreign corporation with respect to a state.” In re Merriam, 36 N.E. 505, 141 N.Y. 479, affirmed 16 S.Ct. 1073, 163 U.S. 625, 41 L.Ed. 287; 20 C.J.S., Section 1785. Title 28, United States Code, Section 297 defines the several States of the union as being “freely associated compact states” in subsection (a), and then refers to these freely associated compact states as being “countries” in subsection(b).

In 1818, the Supreme Court stated that “In the United States of America, there are two (2) separated and distinct jurisdictions, such being the jurisdiction of the states within their own state boundaries, and the other being federal jurisdiction (United States), which is limited to the District of Columbia, the U.S. Territories, and federal enclaves within the states, under Article I, Section 8, Clause 17.” U.S. v. Bevans, 16 U.S. (3 WHEAT) 336 (1818), reaff. 19 U.S.C.A., section 1401(h).

Not necessarily, just take the stabilizing brace off and run a bare buffer tube. His 'proposed rule" as it states, clearly mentions braces.

Now granted, they could just say that applies to ALL ar's with a short barrel, but meh, most of us are ignoring him anyway.
 Quoting: kargatane

What I'm reading is this: The Justice Department will PROPOSE a rule to change certain things. These things are managed by the ATF. If the ATF chooses to implement the rule, it will most certainly be challenged in court where it will need to explain why it's changed its position based on a request from the president.

If the ATF had had a long standing position that the laws permit XY & Z then they suddenly changed them, they'll need a good reason.

I don't see how this ccould stand. It circumvents legislation and I cannot imagine a court disagreeing.

 Quoting: ChefElvis

The way they wrote condition II would not apply to AR pistols, because an AR frame is originally a rifle being converted to a pistol and its by removing a brace.

How condition II reads now is if you take a pistol, say a 9mm Glock, and mount a brace that allows you to shoulder it then it say it would be considered an SBR, which would require a NFA Title III stamp.
