Hey Butch. So in real estate transaction "the commission" is paid via the seller through the sellers broker (agency).

When you are a buyer, should you use your own broker (agency) to represent you, those commissions are split between broker A (seller) and broker B (buyer). While it is unethical to decline an acceptable offer from a buyer with their own agent, almost all brokers want to keep ALL COMMISSIONS for themselves.

So, when you are in a highly competitive market it can be beneficial to request dual agency by approaching the listing (sellers) broker directly. Your offer will be given more consideration just under the rule of incentives...

That makes sense about the commission, but as a buyer would you be under-represented if the broker represents the seller also? Similar to using someone else's lawyer when you fight them in court?

If you hire a very good home inspector (about $300 bucks or so most places for single family dwelling), and a structural engineer (they run about $500 to $1000 bucks), basically DO YOUR DUE DILIGENCE, you will avoid most problems.

This is how many clients are currently writing offers:

So what happens is the sellers see this amazing price come across. They agree. A week later inspection is done. Buyers happy.

A week after THAT the appraisal comes in. It is under the offer. We are now 2 weeks or so under contract, and buyer says "I know I offered 200k but the appraisal came in at 180K, and our contract was contingent upon an appraisal. We can renogiate for 180k now or we have to walk..."

And 99% of the time the sellers agree as they have likely already started packing, setting up utilities at "their new place"... ie they don't want to start ALL over with another buyer.

That's how you get a fair price for a home in a seller's market.

Nobody with a good estate is selling unless they own multiple. Market is very low inventory and mostly trash and everyone is bidding up the trash.

If you have a proper estate you are holding even at these insane levels selling isn’t even an option at this point

This is what most smart people I know are doing. Selling their residence if they've been in it more than 2 years to avoid capital gains taxes. Getting top dollar for it and renting to "play it by ear".
