The beast system is thriving because of the loophole caused by the lack of incorporation of the 7th Amendment onto states through the 14th Amendment. Federal legislation often exploits this feature. Those in the system have deliberately allowed this condition to fester in order to weaponize certain features that would be unconstitutional if the 7th were rightfully incorporated.
