A signed HIPAA release form must be obtained from a patient before their protected health information can be shared with other individuals or organizations, except in the case of routine disclosures for treatment, payment or healthcare operations permitted by the HIPAA Privacy Rule. Releasing medical records without a HIPAA authorisation form is a HIPAA violation.

Yes this is the point: they can’t mandate you to sign a release. Once they do that HIPAA is dead.

Btw, I know they don’t care that they would be killing HIPAA protection,. Just saying that it would in effect be dead.
