I am just saying that shooting someone at 11 pm through a wall who is outside is a bad idea. Unless they are smashing the side of your house with an ax, there is no way to know who you are killing.
It could be your neighbor's buddy playing a prank and he got the wrong house. You don't know.

If the peeping tom was on her balcony, porch, garage or inside the house, then yes, she has the right to shoot him dead even if he posed no threat. But if he was on the front yard or some non-fenced grass area around the house, she should have threatened him, given him a chance to leave, then shoot if he refused.
However, private property or not, trespass or not, if you feel your life is immediately threatened, you can shoot someone in self-defense anywhere in Texas.
So, her case in court would depend on whether an average person would have felt they were in imminent danger of a break-in, murder, rape or robbery, unless the perpetrator was on a finished part of her property (e.g. porch, balcony, etc.)
