Re: Texas woman uses rifle to shoot, kill alleged 'Peeping Tom' caught peering into bedroom window
It probably will end up being a weirdo, and I like seeing the weirdos get it too.

I am just saying that shooting someone at 11 pm through a wall who is outside is a bad idea. Unless they are smashing the side of your house with an ax, there is no way to know who you are killing.

It could be your neighbor's buddy playing a prank and he got the wrong house. You don't know.
 Quoting: Uncle Gintel

Anyone uninvited on my property who is sneaking around looking into my windows obviously doesn't have "good" intentions.

If you don't want to get shot, don't trespass and don't play stupid "pranks" that involve invasion of privacy and security.

Got it, shit-fer-brains?

Here is the part the DA will ream her ass over.
She had a rifle. She shot numerous times through the wall, ending up striking the male.
Technically, shooting through a wall, unsure of the target’s exact location can be viewed as a “reckless discharge” and “aggravated endangerment of the public at large” for those of you who never had to justify a shoot. That’s the legal problem here. Lawyer up time here.
 Quoting: redhed6971

Can't tell half these idiots anything. She should have lawyered up BEFORE she ever talked to the police. If she didn't call 911 BEFORE she shot this guy, she damn sure should have called a lawyer before she called 911 to let them know she shot him or at least right after. Hell, she should have got her gun, called 911, warned him that she had a gun and already called 911 and THEN told him that he should leave her property or she would shoot for fear of her life. These morans don't understand gun laws. Good luck to them on staying out of prison.
 Quoting: Anonymous Coward 74543545

Exactly I was raised with 2 lawyers in the family. They don’t know shit. It’s my experienced shooting buddies who have seen and reviewed cases, attended classes done their legal homework who will tell this.
 Quoting: redhed6971

The biggest mistake she made was contacting law enfarcement at all....they are NOT interested in protecting innocents from harm only making money from them when they are hurt by other criminals.

She should have made the criminal actor disappear and
kept quiet, problem solved.

I have a very innocent, sweet, son with Autism and ID. Not often but he has walked up to peoples windows on their front lawn to look inside, just because he is curious.

Same thing when he was younger but worse. He use to just walk into unlocked front doors or walk straight in un invited when people opened their door. Not everything is as it appears. It should not be a death sentence to look in someone windows, no matter how unnerving it is foe the person inside.

So, I would call this a murder.

Now this advice ^^ is spot on. Though, if she feared for her life - and I mean terror - then she's likely not thinking about legal protection. She's in innate survival mode reacting to, and protecting herself from, imminent danger.

prowling around houses at night is not only extremely stupid i a heavily armed area, it's also a crime. The piece of shit got what he deserved.

Don't do dumb shit and then get all butthurt because you got shot doing it
 Quoting: Irredeemable

I agree it's really stupid and I would definitely draw my gun if inside the house. I am also not putting down eliminated perverts.

What I am saying is, you really don't want to kill someone legally unless you can prove they are an immediate threat. You also don't want to live with killing some down syndrome kid.

We had this down syndrome kid that would wander the neighborhood. He was totally harmless but would wander into peoples yards and stuff.

If someone like that had gotten lost at night on a walk or something, I would not want to live with having lit his ass up through a wall.

Now if they smash the window or are trying to gain entry, that is a different story. Once they are trying to forcefully gain entry, light em up, but I think this had not escalated to an use of deadly force justification.

If she would have shot through a window looking straight at him LE might let it slide....but shooting through a wall?

No way fucktards. You never fire a weapon unless you are certain of the target. Spray and pray through a wall is fucking psycho.

In Texas, you better have a good attorney for this defense which is a valid one. Someone triggered into fight mode is not thinking of gun laws and is operating from a primal place BUT I can tell you personally, and I'm in Texas, you better have a good fucking lawyer for this defense. Court appointed will not do. My niece is about to max out on 6 for defending herself from a guy who was habitually drugging and trafficking her. She was NAKED chasing him down the street with a machete and had already done damage to him. Any DA would have said she had a duty to retreat. It would have taken a good lawyer to argue the physiological fight response.

I believe if you are going to own firearms, you should be required to take safety, operating classes, and pass a test, jut like we do automobiles to own your firearm. Minors as young as 8 need to have an age appropriate permit for rifles until 12 and at 13 include handguns. They should only be operated in the presence of an adult over 21 years old.

Then everyone should be on the same page on when you can shoot a suspect.

I NEVER thought I would kinda sorta agree with Uncle Gintel.
But here I am.

I think this situation calls for some serious "Home Alone"
type retaliation,
But shooting through a wall at an unknown person outside?

No. Not for me. I'd go check the dude outside, armed, and
dispatch if necessary.

I know a chick probably would not be comfortable with that,
and rightly so.

But blast away?

I think not. Call a man friend to help or the cops.

Be ready. If he breaks, enters, etc, BLAST AWAY.

Not blindly through a wall.

Nobody was trying to force entry so she can't show it was justification for use of deadly force.

This would not even hold up under castle law.

She should have called to police. If he was trying to gain entry, then it is a use of deadly force.

No, and what if he decides it’s a touching thing…or worse….

I don’t agree with shooting through the wall….mainly because if you have neighbors and you don’t worry about beyond your target , you’ll accidentally kill your neighbors, their dog or someone else that’s an unintended target.

If she did it right, she would have called police….and only shooting if there was a real threat to her life, or he started to enter the home. Then stood her ground in the house with her firearm.

A) Perp was trespassing
B) It was dark and late at night 11PM
C) Perp was peeping into the victim's bedroom window.
