Very unlikely. The one who really needs to worry is the young lady acting as the armorer. She is on record as saying she was uncomfortable with the job as she was worried about her abilities to carry it out successfully.

The gun was given to him as unloaded. Perhaps if they can show he was acting in callous disregard to safety and behaving foolishly and pointing the gun at everyone they could charge him but doubtful.

Nobody had intent so at most manslaughter but doubtful any sort of jail time but a lifetime of knowing what happened would be punishment enough. I can’t imagine the victims willing to have someone jailed or the family. A tragic accident.

In New Mexico, if he was charged with involuntary manslaughter, he would receive at maximum 18 months under the circumstances! That automatically gets reduced by 50%. Thats 9 months! Add the fact he is a celebrity, with “overcrowding” in corrections, he serves 30-60 days in county jail!

With that said, let’s look at some possibilities. Prop guns,cannot, under law, fire an actual cartridge, the bore is to small, plus they usually have changes to the magazine. They were filming in the desert in a rocky area. The production Armorers (there are always two, unless they broke the law) are required to clear, check, inspect, and load blanks prior to giving it to the actor! However, with that said, Alec should have double checked the weapon regardless! Let’s say the armorers did all the checks, inspections, loaded the pistol with blanks and while on the way to give him said weapon, they dropped it in the rock! This could have easily lodged a large rock or multiple rocks into the barrel! They think it’s no big deal, and BOOM! Catastrophe!

From Reuters - Alec Baldwin was handed what was described as a safe "cold gun" on the set of his movie "Rust", but the gun contained live rounds when it was fired, according to details of the police investigation into the fatal shooting released on Friday.

People in Hollywood are retarded and live in a fantasy land. I would bet the gun handlers and or crew decided to have some real target practice with real bullets after the filming wrapped the day before, and they forgot to unload and reload with blanks.

The really stupid part is Baldwin was probably waving his gun around jokingly and pulled the trigger while pointed at the director. That is negligence. If he was drinking at the time, he is totally screwed.

Live firearms, not props, must be conducted on RANGE! In a controlled setting! If you are correct, and they used a non modified weapon for the movie, not only are there financial damages, there could be criminal charges of the armorers! I still don’t think Alec suffers criminal charges! He bank account however?

I doesn't matter who you are, if your going to be the person firing a gun, it is your responsibility to check it out. After all the prop gun or was it a real gun when fired and causes an explosion. I would want to make damn sure the gun I was in control of is safe. I realize he is an actor and he's busy acting....but he should have still given that gun a look see before aiming at someone and pulling the trigger. It's not rocket science and I'm sure Alec is not a total dumb ass. No way can he come out of this totally innocent, he bears a lot of the responsibility for fooling around with guns.
