the scotus can not hear a case that does not exist yet. Someone has to be damaged by the mandate then bring suite then appeal a couple times then petition the scotus and IF they feel it has standing they MIGHT hear it.
The court does not make laws or mandates and does not rule on their constitutionality UNTIL there is a case appealed to them in the proper form and language.
