They have nothing! Every company who either term'd someone, or worse, violated their personal conscious to compel the thing, will have to litigate on their own (lawsuits). They can't point to the gov and say "it's the rule!" Because the rule will never be in effective. Even the EO only covers new contracts after that date and a company still incurs the liability! Just because a client demands you do a thing to your employees to get the $$$$ doesn't mean that isn't on you! The thing is neither safe nor effective. None of that flu shot precedent is going to protect them with what is currently known. Add in severe injuries/deaths and most US corps will be bankrupt.
