That would undermine our entire civilization and form of government. That is the same as saying the police can't arrest someone for being suspected of a crime either. The government, nor any of it's administrators, can have any powers the people do not themselves possess. If I don't have the right to do something, then no agent who works on my behalf may have it either.

If I interrupt what appears to be a rape, are you suggesting I cannot apprehend and use force against the suspected person? If he attacked me am I not allowed to respond.

I'm not weighing on either side of this particular case, but the thinking you just put forth destroys the rule of law and makes anarchy inevitable.
