Nope, he explored a home construction site. He may have been looking for tools or whatever. But he didn't take anything at that time.

No, it is not. If there are signs and a fence maybe. Criminal Trespassing requires some other crime to be trespassing. You cant jump someone for coming onto your property and try to "Arrest" them with a shotgun and you DAMNED SURE cant do it on a public street. Trespassing on construction sites in some states is a felony because of the giant theft problem.
