Arbery was a criminal long before this incident and was never really punished for his actions. That is why this incident occurred.

Under Roman Law as well as many other later societies, people would actually be punished in order to get compliance. If Arbery had been beaten to an inch of his life on his first occurrence with the standard 40 lashes like under Roman Law, perhaps he would have changed his ways and still be live today.
