No, trespassing and entering a home without permission. Doesnt justify a death sentence for Aubrey, he was stupid enough to pull the gun towards him. At least point that shit to the side if your going to try to Rambo strong arm a shotgun from someone pointing it at you.
Quoting: Anonymous Coward 78823371 NO TRESPASSING OCCURRED. The only way it could have been trespassing is if the OWNER had warned him off previously or there was a crime committed by him while he was there. Just being there IS NOT trespassing, not in ANY STATE, not even Texas Quoting: Anonymous Coward 81227119 Trespass most definitely occurred: TrespassTrespass is defined by the act of knowingly entering another person’s property without permission. [ link to www.law.cornell.edu (secure)] Quoting: Anonymous Coward 80171604 The court ruled Aubery committed no crime, primarily because the landowner did not care that he was on his property and testified to that effect, and that no crime was actually committed. The legal definition of trespassing is not the dictionary version. "Trespassing" means to do wrong to another in the mots basic sense of the word. There has to be some intent to do wrong or you have to be warned off. What you poeple are saying is it's ok to shoot a kid selling cookies if he knocks on your door, you're fucking dangerously insane. It's ok to shoot anyone for any reason if theyre black Quoting: Anonymous Coward 15447775 The Black man trespassed. His act of trespass was not legally or lawfully actionable as you point out because the owner did not desire to pursue the matter. That does not change the fact that the Black man's action raised suspicion and precipitated the tragedy.
