Quoting: Mangia That's exactly what it means. They cannot force businesses to mandate now. A win for you and many others. Wrong - the GOVERNMENT can't force a business to force you. The business can still force you if they want. Sure anyone can force anyone to do anything if they submissively comply, however, that doesn't make it lawful, or legal now does it. Lawyers suck until people need them, but these days we're going to need them more than ever. Submissive and apathetic people will always get bullied and tortured because that is the role they play, but that doesn't mean it's right, or legal. In this case, people have legal recourse to sue now. OSHA SAYS EMPLOYERS ARE LIABLE FOR MANDATED VACCINE DAMAGES AND CANNOT PENALIZE EMPLOYEES FOR REJECTING "If you require your employees to be vaccinated as a condition of employment (i.e., for work-related reasons), then any adverse reaction to the COVID-19 vaccine is work-related. The adverse reaction is recordable if it is a new case under 29 CFR 1904.6 and meets one or more of the general recording criteria in 29 CFR 1904.7. There's the noose. Thanks! |

Everything surrounding this situation, everyone's situation needs to be done in writing, if they fail to do so, keep insisting that you'll do nothing until everything has been put in writing. That should always happen in work situations, verbal words are like farts in a 100 mile per hour wind, gone and never even missed. Lots of people will have nice retirement accounts from the lawsuits that are about to unfold. Enjoy! |

Quoting: Anonymous Coward 79094923 The vaccine mandate for healthcare workers vote was 5-4 with Thomas, Alito, Gorsuch, and Barrett in dissent, which means Roberts and Kavanaugh joined liberal justices in allowing the HHS mandate on healthcare workers to stand. What was needed was a firm affirmation that the government has no right to force people to take injections. That didn't happen. From the ruling: Permitting OSHA to regulate the hazards of daily life - simply because most Americans have jobs and face those same risks while on the clock - would significantly expand OSHA’s regulatory authority without clear congressional authorization. So, basically, they're saying that if Congress were to "authorize" it, then it could stand. Not anymore it can't, they already ruled. Congress missed its chance. lmao! They also made it clear here by telling all these tards that it needs to be sorted out on the state level now, but after this monumental ruling, the lib-tards got neutered, so they don't stand a chance in any courts now. lmao! "Historically, such matters have been regulated at the state level by authorities who enjoy broader and more general governmental powers. Meanwhile, at the federal level, OSHA arguably is not even the agency most associated with public health regulation. And in the rare instances when Congress has sought to mandate vaccinations, it has done so expressly. E.g., 8 U. S. C. § 1182(a)(1)(A)(ii). We have nothing like that here." Talk about schooling the governing body of idiots, and telling them in a legal way they are 100% incompetent. It was brilliant. You are so right after this congress missed the boat; they cannot write the law to force it after the ruling. It is done and already law and this part is ended. Now if they could get a case for the companies who are firing people because they want to force people to take a vaccine that is not a fully approved vaccine, using vaxxed and unvaxxed then this is the same as any other law about people rights, it the same as not serving, or hiring a person because of something like color, or sex even though they are qualified, or firing them for the same. If a person doesn't want an untested vaccine, they are not by law forced to do so, even by their employer, losing their job because of a vaccine is not a winning policy. Sorry I got a headache These are the times that tries men's and women's souls! May we come though it victorious! |

Can you say massive court clogging? Final State by Justice Gorsuch. Historic Opinion that will go down in history. "The question before us is not how to respond to the pandemic, but who holds the power to do so. The answer is clear: Under the law as it stands today, that power rests Cite as: 595 U. S. ____ (2022) 7 with the States and Congress, not OSHA. In saying this much, we do not impugn the intentions behind the agency’s mandate. Instead, we only discharge our duty to enforce the law’s demands when it comes to the question who may govern the lives of 84 million Americans. Respecting those demands may be trying in times of stress. But if this Court were to abide them only in more tranquil conditions, declarations of emergencies would never end and the liberties our Constitution’s separation of powers seeks to preserve would amount to little." Whoa, good, they smacked OBiden's weenie. |
