“FDA must ensure that recipients of the vaccine under an EUA are informed… of the known and potential benefits (sic) and risks, the extent to which the benefits and risks are unknown, that they have the option to accept or refuse the vaccine, and of any available alternatives…”
“21 U.S.C. § 360bbb-3(e)(1)(A)(ii) Appropriate conditions designed to ensure that individuals to whom the product is administered are informed— that the Secretary has authorized the emergency use of the product; of the significant known and potential benefits and risks of such use, and of the extent to which such benefits and risks are unknown; and of the option to accept or refuse administration of the product, of the consequences, if any, of refusing administration of the product, and of the alternatives to the product that are available and of their benefits and risks.”
Quoting: Anonymous Coward 78914227 First: this statute does not contain a citizen suit provision which allows individuals to sue for alleged violations. Second: people have the option to accept or refuse the vaccine under any circumstances. They’re free not to get vaxxed, and the company is free to part ways with its employee. Simple enough. Quoting: Anonymous Coward 80928359 You cannot force this… you can try to spin it however you want but mandating an EUA drug is illegal… The only reason they are doing it is because you people are to stupid and weak to stand up for yourself. Quoting: Anonymous Coward 78914227 You clowns don’t get it. I’m saying there is NO LEGAL RECOURSE here in the United States of the type you’re describing. Do you not understand? I agree with you that it’s wrong and SHOULD be illegal. I’m telling you that it plainly IS legal under established law and precedent for employers to mandate a jab. Good luck finding a lawyer to represent you. It won’t happen.
