Labor & Industry addresses unemployment fraud for Pennsylvania House committee

Representatives from the Pennsylvania Department of Labor & Industry and the Office of Administration discussed ongoing fraud and other issues in the commonwealth’s unemployment system Thursday during a House hearing.

Pennsylvania Secretary of Labor & Industry Jennifer Berrier told the House Labor and Industry Committee that “overall the (unemployment compensation) system is in a good place,” but acknowledged a raft of ongoing issues, from hundreds of millions of dollars stolen through fraud to large backlogs of unresolved claims and fraud cases.

Berrier said the unemployment compensation system has processed more than 611,000 claims since the modernized system went live in June, paying out about $3.4 billion in benefits. During the height of the pandemic, the department faced a backlog of 300,000 nonmonetary determinations, or those involving eligibility, that since has been whittled down to 95,000, she said.

“Currently our examiners are issuing between 17,000 and 19,000 determinations a week, and our system is able to issue a couple thousand, depending on the issue,” Berrier said.

The secretary also addressed fraud from identity theft and bank hijacking publicized by the media. Berrier said the department implemented ID.me verification a month after the new system launched, but “we still continue to struggle with fighting fraud, but also continuing to pay claimants in as timely way possible.”

Berrier said the efforts have helped, though a recent increase in seasonal workers applying for benefits has resulted in an uptick in fraud in recent weeks.

“I think what we’re finding is, especially with these seasonal workers, they’re finding that they’re the victims of identity theft from when our system first went live,” she said. “Also we’ve had issues with bank hijacking, which I know has been relatively new.

“But I am happy to report that we’re seeing noticeable decreases in fraud reports,” Berrier said, “which means that the levels of security that we’re implementing are working.”
There is a backlog of 37,000 pending fraud cases.

Berrier highlighted an Independent Fiscal Office report that showed traditional unemployment benefits paid out to fraudsters from March 2020 through the third quarter of 2021 was about $570 million, or about 6.3% of the typical payments made during that time frame.

New Pa. unemployment ‘bank hijacking’ cases down; backlog of fraud cases still high but shrinking

HARRISBURG, Pa. (WHTM) — Department of Labor & Industry leaders confirmed for the first time Thursday they’ve implemented security measures to specifically prevent the altering of direct-deposit banking information by fraudsters. And they explained for the first time why they chose last year not to implement multi-factor authentication measures that cybersecurity experts have said could have prevented much of the “bank hijacking,” as leaders have called it.

“We will not rest until we stop this in its tracks,” Secretary of Labor & Industry Jennifer Berrier testified Thursday to the Pa. House of Delegates Labor & Industry Committee.

Berrier said the department is working through a backlog of fraud complaints that now number 37,000, down from more than 50,000 in recent weeks. These include the “bank hijacking” — that is, diversion of unemployment checks into fraudulent bank accounts — in recent months as well as an earlier wave of fraudulent unemployment claims filed using the identities of real Pennsylvanians.

Susan Dickinson, L&I’s deputy secretary for unemployment compensation, told the committee the department has implemented “some final changes this week that seems to be working well so far,” with no new known bank hijacking cases “happening the last few days.”

Watch your tax returns Pa'ers. If you were on unemployment in 20 or 21 & hadn't received a check or even if recd a partial check from PUA, you file & haven't received a tax document, be prepared for a possible IRS audit.

Some ppl had benefits interrupted in 20 while 200k ppl are still owed benefits from 20. Same in 21. The IRS can take up to 3 years to audit. This'll rack up 3yrs of interest & penalties. Be careful. Try to make inquiries about this to cover your ass.

Remember the states been pontificating fraud. 10billion in alleged unemployment monies stolen by Chinese & Russian hackers which is BS to the highest order. Funds been insolvent since March of 20. They borrowed 800mil in August of 20 & 1bil in October of 20.

The fund was insolvent within 3months of the initial lockdown from all the claims. State had to borrow 800mil in August of 20 & another billion Oct of 20.

Claimants as early as March of 20 began having their benefits STOPPED without warning/explanations. Ask them. Some 200k claimants remain UNPAID from 2020. 125k+ new claims since Sept of 21 remain unpaid as well.

440,000 unemployment claims have been flagged as potentially fraudulent between when its new computer system went online last summer and the end of 2021.


Jerry has been trying unsuccessfully to file for unemployment benefits since October of last year, and has been depleting her savings. She’s hoping she’ll soon get what she’s owed after months of assistance from her state senator’s office.

Her situation encapsulates a problem Pennsylvania’s unemployment compensation system is still grappling with, close to two years after the tsunami of claims at the start of the pandemic — the state Department of Labor & Industry must figure out how to reject fraudulent claims, while still paying legitimate ones.

Legislators and advocates say the problem is massive, with serious consequences for people like Jerry and others who are owed money.

First time unemployment claims in the U.S. were up by 23,000 to 230,000 filed for the week ending January 8. Thursday’s report from the Department of Labor showed that the U.S. states of Pennsylvania, New York and Connecticut saw the largest increase in new claims.

Business representatives are encouraging Democratic Gov. Tom Wolf’s administration and the Republican-led Legislature to use federal coronavirus relief money to restore the state's unemployment fund.

Pennsylvania continues to sit on a tad less than half the covid relief 7.9bil which it could be using to pay these claimants. Some 200k from 2020 remain unpaid. 116k+ new claims added.

Pennsylvania just made its final payment in January 2020 on $2.8 billion of bonds issued to repay the federal government for unemployment compensation loans stemming from the Great Recession. A few months later, it had to start borrowing again because of the pandemic. The state now owes the federal government nearly $1.6 billion for unemployment loans

State Unemployment Fund Returns to Crisis

The unemployment insurance fund was neither replenished nor reformed after running out of money in 2008. History is now repeating.


The last national economic crisis was 12 years ago. Pennsylvania’s unemployment compensation fund went into debt at that time.

When the unemployment compensation fund is in debt taxes are higher, thereby increasing the cost of hiring.

In January of this year the commonwealth finally repaid the debt but it never fully replenished the fund. The fund has been debt free for less than two months in the past 12 years.

A new crisis has arisen as the viral pandemic drives unprecendented numbers of unemployment claims.

The unemployment system should be reformed after this crisis passes.

UI is funded jointly through state and federal unemployment taxes, which are both paid by employers on all wages. Federal unemployment tax is 6 percent on the first $7,000 of every worker’s wages. Pennsylvania state unemployment tax varies by formula from the low single digits to about 10 percent, with employers in industries with a high frequency of worker layoffs (construction, for instance) paying more. While such an arrangement is standard among the 50 states, Pennsylvania’s tax is among the highest, largely because the fund from which it pays claims has historically been in poor financial condition.

Insuffiicent Reserves
Unemployment taxes flow into the State Unemployment Insurance Trust Fund at the U.S. Treasury. Benefits are paid out of these accounts. If a state’s account runs out of money, it can borrow from the federal government. Ideally, states build up balances in good times to fund recessionary times, and the national system as a whole never goes into debt. The national trust fund contains $75.7 billion. Pennsylvania’s fund contains $3.4 billion.

The fund’s solvency is measured by the Average High Cost Multiple (AHCM). Simplified, the AHCM is the fund balance divided by a smoothed average of recessionary year claims. The federal government uses a value of 1 as a solvency standard. Pennsylvania’s AHCM is 0.65, indicating it would be unlikely to pay all claims in an ordinary recession without borrowing. Pennsylvania is the 12th worst in the nation by this measure. 

Repeating History
The banking crisis of 2008-2009 is instructive. At that time, millions of people nationwide drew benefits, eligibility and duration of benefits were expanded, and, even though much of the expansion was paid for by the federal government, Pennsylvania depleted its UI trust fund. Collections in prior years had been insufficient to build a high enough AHCM. In fact, Pennsylvania has not achieved an AHCM of 1 since 1971.

Analysis: Pennsylvania’s unemployment trust fund faces insolvency as pandemic continues

Pennsylvania’s unemployment trust fund, the mechanism used alongside the federal CARES Act to provide benefits to unemployed residents amid COVID-19, could face insolvency if the number of claimants remains high into the summer.
According to a recent report from the nonprofit think tank Foundation for Government Accountability, Pennsylvania’s unemployment trust declined 22.1 percent between Jan. 1 to April 16 – a snapshot in time that includes the first month of layoffs after Gov. Tom Wolf placed restrictions on residents' activities, including closing businesses deemed nonessenital.


At the beginning of the year, the state’s unemployment trust had a balance of $3.43 billion, but declined to $2.67 billion by mid-April as claims skyrocketed.

While each state finds itself in the challenging position of unheard of surges in jobless claims, researchers Josh Waters and Jonathan Ingram with the Foundation for Government Accountability said the fiscal health of each state’s unemployment trust varies and is not necessarily corresponding with the number of claimants.
According to figures from the Pennsylvania Department of Labor and Industry, the state’s unemployment rate in April of 20 was 15.1 percent. but Waters and Ingram estimate it will be around 31.2 percent, or 8.8 percent above the national average of 22.4 percent.

Pennsylvania’s unemployment fund was almost solvent, then the pandemic hit


Pennsylvania’s unemployment system was in better shape than it had been for years when the coronavirus pandemic struck.

But the unprecedented wave of more than 2 million people who filed claims for unemployment benefits as businesses were shuttered to stop the virus’ spread drained the state’s unemployment trust fund.


The fund was on track to become solvent for the first time in nearly 50 years, according to the U.S. Department of Labor, and the state in January finished paying off billions of dollars in debt incurred to prop up the unemployment system during the Great Recession more than a decade ago.

Now, with $4.6 billion in state unemployment compensation benefits — not counting federal emergency benefits — paid out since mid-March, the fund is depleted and the state Department of Labor & Industry is planning to borrow again to keep payments flowing.

The borrowing comes at a time when state officials are also grappling with what they call a poorly conceived plan to replace the federal government’s $600 weekly payments with a program that calls on financially stressed states to shoulder a quarter of the burden.

The state is approved to borrow up to $2.8 billion through October. Beyond then, officials cannot say whether additional borrowing will be needed.

“I wish I could predict whether we need to or not,” Labor & Industry Secretary Jerry Oleksiak said in an interview this month. “There are so many unknowns moving forward and so many of them out of our control.”

Regardless of how much more the state borrows, employers and workers will feel the effects of the pandemic on the unemployment system, said Jared Walczak of the National Tax Foundation.

“This is a very significant bill and it is one that is going to saddle Pennsylvania with debt for many years,” Walczak said.

State Sen. Camera Bartolotta, a western Pennsylvania Republican who is majority chairperson of the Senate Labor & Industry Committee, said it’s important to have a plan. How the state repays the money it borrows could affect how much employers and workers have to contribute to the system in the future.

Pennsylvania borrowed nearly $4 billion dollars as the effects of the Great Recession hit the workforce in 2010.
