I talked with an advisor (not an attorney) who said I couldn't win in court because the Constitution doesn't protect my rights in private businesses, on private property, only from the government's intrusion or infringement upon them. If you can prove the business discriminated against you solely because you're a Christian, you have a case but if they threw you out because you were disturbing customers and not because you're a Christian, then you have no case. It's worth noting that a recent USC cake case actually went in favor of the baker because he refused solely on religious grounds and not because the couple in question was gay. His advertising and signage also clearly state his bakery operates in accordance with his religious beliefs. He didn't spout off saying he hated gay people or that he wouldn't bake a cake for a gay couple, he simply said he couldn't bake a cake that wasn't in accordance with his religious beliefs, and he won. |
