(CMS) = CENTERS FOR MEDICINE & MEDICARE SERVICES they are part of (HHS) = DEPARTMENT OF HEALTH & HUMAN SERVICES  CMS Rescinded the Vaccine Mandate for its Federal Employees Who Enforce the Federal Vaccine Mandate Against Hospitals CMS is the HHS federal agency tasked with policing the 100% federal vaccination mandate for U.S. hospitals receiving Medicaid and Medicare funds. While leaving the 100% federal vaccine mandate for hospitals in place, on June 16, 2022, CMS rescinded the vaccine mandate for its employees who are assigned to police the 100% vaccine mandate for hospitals. Indeed, CMS prohibits hospitals from even inquiring about the vaccine status of CMS surveyors, while part of the CMS surveyors’ job is to inquire about the vaccine status of hospital staff. JUNE 16th 2022: "Memorandum Summary CMS is rescinding and hereby removing the January 25, 2022 Memo regarding Vaccination Expectations for Surveyors Performing Federal Oversight (QSO-22-10-ALL) from HHS's guidance repository. CMS is rescinding QSO 22-10-ALL. As stated in the original guidance document, "State Survey Agencies and [Accrediting Organizations] are ultimately responsible for compliance with this expectation." The federal government has explained that the guidance does not include any possibility of penalties for noncompliance, and further prohibits facilities from inquiring about surveyor vaccination status. We understand that there is nonetheless some ongoing confusion about this guidance, which we expect this recission will resolve." |
