The federal government actually has very little power, according to the Constitution. The Commerce Clause is one of the few powers enumerated. The reason the Feds are up in everything is the "power of the purse". States don't do what the Feds ask, well, your grants just got removed or reduced. Wave bye bye to your money we usually give you (and is heavily relied upon). This is Constitutional Law 101 for law students. SCOTUS would have to somehow reduce the power of the feds to take away or reduce funding AND reduce the power of the Commerce Clause, which has been interpreted to apply quite broadly. I'm interested to see what will happen next and how this will look. |
