Technically it is murder because the shop owners life was not threatened.
The jury will review the shop owner demeanor and determine he did not feel threatened
Neither robber brandished a weapon and the murdered one was much smaller than the shop guy
Stabbing to death someone who is not actually physically threatening you will make the stabber the bad guy.
He 100% over did the stabbing and appears a cold blooded killer
