Trump legal threat against CNN stops short of arguing that his election-fraud claims are true, says only that he 'subjectively believes' them

In their legal threat against CNN, former President Donald Trump's lawyers stopped short of saying his election-fraud claims were true, saying instead that the former president "subjectively believes" them.

In a 282-page document submitted to CNN last week, Trump's legal team said it would sue the network unless it issued a correction, apology, or retraction on stories about Trump, including ones where it dismissed his claims of voter fraud in the 2020 election.

Trump said on Wednesday that he had contacted CNN to say he intends to sue.

In their document, the lawyers said that CNN repeatedly said Trump was "lying" but that Trump could not be lying as he "subjectively believes" his loss was due to voter fraud.

"In this instance, President Trump's comments are not lies: He subjectively believes that the results of the 2020 presidential election turned on fraudulent voting activity in several key states," the lawyers wrote.

They said that CNN started accusing Trump of lying before audits and recounts took place in states where Trump alleged there was fraud.

They also used a dictionary definition to argue that Trump could not be lying.

"Webster's Dictionary defines a 'lie' as an assertion of something known or believed by the speaker to be untrue with intent to deceive," they said.

From the court filing saying that Trump is not lying about election fraud because he believes there was election fraud even though there’s no evidence to objectively confirm his belief.

He subjectively believes that the results of the 2020 presidential election turned on fraudulent voting activity in several key states.

President Trump harbors a subjective belief that he was unfairly deprived of a second term in office.

It’s amazing. Mike Lindell also subjectively believes there was massive voter fraud.

And he’s going to drop the hard evidence to prove it in less than two weeks.

Trump hasn’t even filed the lawsuit yet but he’s already grifting it:

Former President Donald Trump asked supporters Friday in his online newsletter for donations toward his “impending” lawsuit against CNN for calling his claims of voter fraud regarding the 2020 presidential election “baseless.”

“I’m calling on my best and most dedicated supporters to add their names to stand with me in my impending lawsuit against fake news CNN,” wrote Trump. “Add your name immediately to show your support for my upcoming lawsuit against fake news CNN.”

The email concluded with a link to Trump’s online donation portal. The Republican National Committee (RNC) has warned Trump they would stop footing his legal bills if he declared his presidential candidacy for 2024.

The RNC has paid nearly $2 million to companies that represent Trump since October 2021.

Trump’s fundraising request came after his attorneys hit CNN with a 282-page letter in July demanding the media network remove all uses of “the big lie” and “lying” from its coverage of his claims that the election was fraudulent.

This can't be settled in court because the justice system is corrupt. It's not going to be reformed and the integrity of elections isn't going to be secured.

If there was, Trump’s lawyers would show it and they wouldn’t call it “subjective belief”.

Did they ever put forth a definition of "hard evidence"? What evidence would accepted as "hard evidence"?

Video of mass ballot drops? No?
Video of ballot rescanning by poll workers? No?
Evidence of database tampering, deletion, obfuscation on election machines? No?
Evidence of internet connectivity on election machines - last minute software "updates", etc.? No?
Blocking and ejection of election observers? No?

It's easy to flatly state there is no "hard evidence" if you simply refuse to define "hard evidence".

You didn’t even mention the rate at which ballots had to be adjudicated (which means re-filled out by the friendly Liberal voting station staff). I don’t have the numbers in front of me, but there were some counties with an adjudication rate as high as 60%, when the machines are not supposed to be certified if above 1%. Also, large numbers of counties nation wide (that used the machines) had adjudication rates well above 10%+.

Anyone with eyes to see knows there was voter fraud. Add the 2,000 Mules documentary to that list too. Lastly, why the hesitancy to perform extensive/transparent audits?

There is no question there was cheating, the real question is how much.
