Yeah, you’re right… I watched the video again.


At the first day of school my sons bring a bunch of papers to be signed by the student and parents… one of them is that we acknowledge about cell phone policies; students are not allowed to have their cell phones on their desks or hands during class periods cuz it will distract them and their classmates…


I think the teacher should have sent him to the principal office at the very first moment the student started asking for the phone to avoid any confrontation… she should have handled the situation in a different manner…

Well, we don’t know if the class period already ended… if that’s the case, the teachers should have returned the phone…


It’s very sad to watch the video… we don’t know the boys’s emotional state.



My boys know that I won’t tolerate them misbehaving at school, specially disrespecting teachers… but at the same time teachers know that I won’t tolerate my children being mistreated… my school district calls me “mama ***”. chuckle

Okay...

What I saw in the video...

The kid requested his phone back, the aggressive teacher towering over him, standing far too close, using intimidation tactics. (She appears to be female. Not assuming gender, but has a good six inches on the tiny guy.)

Not illegal.

The tiny fellow reaches for what one assumes is his property. A, no doubt expensive phone. She attempts to block him from doing so, and makes physical contact. This is light, and pretty close to instinctual, but she is at that point stealing his phone, not legally confiscating it. (She has no legal right to steal, after all. We tend to assume that privilege for teachers, but it isn't inside the actual law, if that were to be enforced properly. Also, the presumption is that it would be given back at some point...)


So, at this point, the teacher has probably commited a misdemeanor... One that would never be counted as such with the police or court, but legal IS such. (Even if you are on the side of the teacher being in the right, due to "authoritah".)

Then the teacher shoves the boy away... This is battery on a minor, using the color of law due to her position. The boy pushed back, which is self-defense, being attacked by an adult...

Then a fight ensues, the teacher continuing her assault, the boy defending, and trying to, one again must assume, gain control of his legally owned property.

*This kid is screwed, but if that had been your manager at work, she'd be facing the judge, not you.

This is one of those things where it's easy to side with the adult. Kids are bad, M'kay? But again, if this woman had been your manager at work and done any of that, she'd be under arrest.

So, if we are going to see vast double standards put in place here, once again.

Liars. Even saying that should have you arrested. The video shows the boy basically shrugging, with a move that might not even be making physical contact. (It's low, and a low power movement, and not "touching" the adult in a sexual fashion, even if it makes contact.)

Now, this is an interesting point. He seems to be pushing her away, first, but she is the one pressing into him. She should stand back, and deal with the situation, without attacking, which she does after that.

Does his nudge count as an attack?

I mean, since he can't get a fair hearing, in any American court, yes, it will. Would it if you were in his position, wanted to retrieve your stolen property?

That one is harder to parse. My guess is actually NO.

If I'm reaching into your car, to get my stolen phone, and you press against me, or start to, a gentle nudge wouldn't count as battery.

A full push DOES, under the law, but the back of your hand, palm in, and low, can't produce enough force to do physical harm.

Again, before anyone gets too full of rage, this kid is screwed. He's doing time for this.

I simply think that it's important to realize that his doing that time is wrong, under our laws, if they were being applied fairly.

The "fight" starts with the teacher attacking HIM, not the other way around. You can't attack people and use the color of law to claim you are the victim. Not if you aren't a cop.

Do they really though? A teacher friendly court is going to slam this kid into juvie faster than you can say boo, even with the video evidence showing that it wasn't an assault or battery by him in the first place.

We all know that. His parents probably can't afford a good enough lawyer to do more than plea bargain. If they did, he'd still probably lose, due to prejudice based on age and bias due to the perceived authority of the teacher.

WE can't allow full beatdowns of people over minor happenings, but we also can't allow public servants to steal or batter children.

The problem I am seeing here is that the state only has the ability to understand one viewpoint in a matter such as this. The one backing "their" people. It is the same issue that good people have with the police. (Yes, if you blindly back the cops, you are not a good person. Sometimes they are in the right, but they often get away with crimes, because of bad people backing them without thought.)
