US Military UCMJ calls for punishment up to and including death penalty for malingering. They wouldn't employ that harsh of penalty in peace time. But if there were ever an extreme conflict where death in combat was almost certain, that rule would certainly come into play. They would have to make an example of penalty for cowardice or everyone would be deserting or intentionally injuring themselves. Look at Civil War - anyone who ran was ordered shot on the spot by his own ranks. They didn't fuck around.
