A person can be detained for suspicion of crime or for investigation of involvement in crime and could be released without any charges ever being filed and cleared and never have a mugshot released. In many jurisdictions a mugshot cannot even be released until a conviction is obtained, as is the case in my state, which is a new law in effect for the new year.
