Misdelivered package, lying thieving neighbor

I ordered a 50# bag of diatomaceous earth online, for $27, plus $33 shipping, Fedex.
When it failed to arrive I contacted the supplier who told me their records from Fedex indicated it had been delivered last Friday, and "left in front of the garage"
The problem is, I don't have a garage, .
The big house on several acres directly behind me, acccessed by a long driveway alongside my yard, does have a garage.
I went back there today after work and spoke to the woman who lives there, who denied that she had found my misdelivered 50# bag, but then admitted that they did have a 50# bag of DE themselves.
I asked her where she got hers, she said "Ebay", but couldn't recall what it had cost.

I could vibe that she was lying to me, and had misappropriated my misdelivered package.
Fedex has been contacted by me and the seller, and will try to retrieve the misdelivered package tomorrow.

I can hardly believe this neighbor would lie to me to steal a misdelivered $27 bag of dog-flea repellant.
I think to keep a package addressed to me, as if your own, because it was erroneously left at your door, is beyond sleazy.
I can't believe this is some legal "finders-keepers".
It clearly had my name and address on it, if this neighbor's admitted-to bag of DE is the one not correctly delivered to me.
I believe she had a legal--and moral--responsibility to return it to me, if misdelivered to her.
I think she essentially stole it.
Does the law support me claiming she stole it?

"To appropriate lost or misdelivered property or services of another, or the value thereof, with intent to deprive him or her of such property or services" is a violation of criminal codes in some states, but apparently not in mine.
Any cops or lawyers out there who can offer me insight?

I want legal recourse, with legal consequences.
This person iis a supposedly respected business owner.
Sleazy lying thief too.
If I call the cops will they lagh because of the petty sums involved.
BTW, I learned about DE here on GLP last week, thanks to whoever posted that thread, I can hardly wait to get some...

see if you can get the original fedex label from your neighbor and match that tracking number up with Fedex. If that Fedex number shows that it was indeed delivered on that day then you know ur neighbor is a thief.

The Fedex delivery driver knows where he left it--I'm sure he doesn't deliver too many dense 50# bags of ground dirt.
After they confirm that is where he delivered it, I'm calling the cops to make a report.
Doubtlesss, fedex will make it right, but I think that she needs to be made to squirm a bit for being so petty as to lie about stealing something of so little value, from the neighbor who returns her kid's frisbee regularly.

Possible, but I rarely believe in coincidence.

Put up real or fake security cameras looking down their driveway from your property and from the back yard. My wife ordered a digital camera for me a few years back for Christmas. The camera was due to be at our house via UPS before Christmas so she could wrap it etc. It never made it. After checking with UPS (could have been Fed Ex come to think of it but I forget), it had been delivered. And after many calls and conversations even with the driver, it was found out he delivered it to our neighbor just like in your case. We live in the country like you as well and only have two other homes on our street. He delivered it not to just the wrong house but the wrong street as well. Just one street over.

My wife went to their house and asked them if they had recieved a package accidently that was for us and they said NO! So, after many many phonecalls with the sender and carrier, it was surmised that it was an accident by the driver and we recieved a new one via package insurance that was required by the sender. Recieved it 3 weeks after Christmas. Was a long ordeal for my wife!

Talk with the driver and get him to confirm the dropoff location. We never did get the authorities involved. Sure they would have denied it till the day the died anyhow. Now you know your neighbors better and that they absolutely can't be trusted! Your right, I do not know very many people with a 50 pound bag of d.e. powder and very unlikely for it to be a coincidence.

Thanks for all your replies.
I can't just go push my way in and heave a 50# bag and walk home with it.
I have to let fedex attempt to correct their error, as they promise to do tomorrow, and take it from there.
I simply can't believe that anyone, especially a public business person with local business and a web site, in a business that requires the trust of rather wealthy people, would be so sleazy over so little benefit.
I guess the AKC registered show dog business is off, in these tight times.
Why did she offer the info that they had a similar bag, but it wasn't mine, after going through a show of looking around for my misdelivered one and not finding it?

I had a similar incident as above. I've lived in this neighborhood for over 20 years, neighbor across the street has lived here for over 10. She is only 2 years older than me so we were in H.S. together and her sister is a good friend of my wife. Anyway . . .package was delivered to here house by mistake, (not known to me). I asked the UPS driver about it and he told me which house he delivered to. I went over and asked her if she received a package of mine. She said yeah, but I was gonna give it back to the UPS driver. CHRIST . . I live 150 ft from here front door. And we don't have telephones? I was so pissed I could've spit . . .

Wouldn't the County Sheriff be the one to contact instead of State Troopers? I think troopers are mostly for traffic and highway crimes.

Try the Sheriff, only elected member of LE in this country. They are usually much more responsive because of being elected instead of just appointed or hired.

Of course you have to contact the authorities and I do recommend the County Sheriff's office as they are the most responsive being elected.

A crime has been committed and should be reported. If the neighbor did not take it, you do want to know who did, right? How elese can you find out as you have no power to search or ask questions officially. Giving false info to LE is illegal most places, too.

So DO report it to Sheriff's office.

Just curious. . . where did you get a 50# bag? I get 5# buckets from Jeffers and think 50# bag would be just huge.
