Rod and Carl back from DC. Talked to Rod this afternoon. They've filed two motions into the case. One, a Reconsideration of the Judge's Denial of a Default against the Defendants... and the other a Motion for a face to face (Exparte) with the Judge ! Can you imagine the Judge being questioned by Rod !

We've got docs but there's too many of them and they're too large to effectively send via email. We're trying to get one of our friends with a site to post them out so you can download and become familiar with them. Hopefully, we'll get it done so that the Friday night call might make better sense to you. We'll email the link when we get it.

The Judge's Denial looks like it was written by a clerk or 1st year law student. Lots of suspicious assumptions, etc. and nothing really based on Law or Procedure, and which can be rebutted ! And, it was rebutted in Rod's Reconsideration Motion ! So, that Motion is entered into the court - just waiting for the word.

I've enclosed the current (as of 5:30pm 11.11.09) docket notes at the end of this email.
