Saturday evening I was served a summons to appear in court... on Monday?!?
on saturday an officer knocked on my door and after I didn't answer he slid a summons under my door. Apparently a debt collector for capital one bank wants to sue me for 1,222.00 plus fees. The thing is that - on the summons it is stated to the officer serving it that it can be served no later than 3 days before the return date. The summons was written in september but this is the first I've heard of it. I've received many calls from the collector but no mention of a summons until now. I have work in the morning and now I'm supposed to be in court at 9:30 a.m. What should I do?

Go into court and tell them you are SOVEREIGN and DON"T ACCEPT ADMIRALTY LAW!!!

Then ask for the AFFIDAVIT OF SERVICE and check the date, and see if it was at least 3 days before the court date.

SLAM DUNK!!!

Remember not to say "YO GOOBER!!!" to the judge. They don't like that.

Call your credit card company and see if you can work out a payment arrangement.

Most companies,once they have already sent you a summons won't make arrangements. The court will do that for you. If you owe them the money go to work call the judge your supposed to go before and let them know you are not contesting and won't be in court. You can't be jailed for not appearing in civil court. None the less you will lose if you don't appear to state your case. Which if you owe them the money then rightfully so. After judgement is passed if you do not respond. The judge will grant wage garnishments. Then you can file and exemption to keep them from getting garnishments.

I plan on appearing but I don't understand how they can legally serve this by placing it under my door the weekend before I was supposed to appear. It says it's to be served no later than 3 days - they did two. But maybe that doesn't matter and they'll just roll their eyes? I don't know.

What's with the b.s. Flag?

Lol, admiralty law. That's right because we came from the birth canal we considered products of the Sea. Or at least that's what Maxwell tells us.

I'm looking online for legal advice but it's pretty much too late. Any more thoughts?

same thing happened to my friend, he went to court and denied he owed the money, judge threw out the case and he owed nothing. judges dont like these debt collectors at all!, they waste the courts time and they harrass local citizens.

Well, looks like I'll be acting as my own attorney. It also says that there is a court fee to file an appearance for 168.00 dollars - I barely have bus money. So if I don't pay the 168 does that mean they won't let me make an appearance?

I would call the judge and ask for a new hearing date. Tell him you need time to verify the authenticity of the debt.

Each state has their own laws and after so many years no one cannot collect on a credit card debt. This could be one of those scavenger companies.
