User ID: 1233351 United States 01/17/2011 02:51 PM Report Abusive Post Report Copyright Violation | What happened was they got in trouble by the EPA for having excessive inflow of clear water. They have to check the outside of the properties to see if any inflow is coming from personal properties. The letter does sound threatening, but they are just trying to cut the flow down to the treatment plant, because they are exceeding their totals per day on their permit. |

Stop the inanity! User ID: 918879 United States 01/17/2011 03:07 PM Report Abusive Post Report Copyright Violation | It says that the utility will be fined if it is found to not be in compliance, but never states what would happen if an individual refuses to allow the inspection, other than the threat of higher rates. Also, I love the "guilty until proven innocent" stance the company is taking toward their customers. Until they inspect, you will be considered a source of "clear water discharge." What ! Repeal the 17th Amendment and the Reapportionment Act of 1929! Thread: First steps down the road to a return to the Constitutional Republic that we were intended to be. Restore the Republic. Thread: The Bill of Rights does NOT include age requirements! It's a flower, not something to be feared. - Moo! |

Quoting: Yee HawMost of the time you won't even know they are there. They will just drive by and do a visual check. The only difference here is they told you before hand. big difference between driving by for a visual check, and trespassing on your property. |

If they suspect your contributing to the infiltration (this is illegal) they can go on your property to make sure. If you refuse them onto your property, the water dept will then call the police and the police will try to get you to understand the importance of the matter so you can avoid fines and court costs. |

Anonymous Coward User ID: 1233712 United States 01/17/2011 04:06 PM Report Abusive Post Report Copyright Violation | I would have no problem with having my home inspected by the government. I have nothing to hide -- if you do then it probably means you are doing wrong! Quoting: Anonymous Coward 1233503What part of this don't you get? Amendment IV The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. |

This falls under probable cause. Something is causing an increase in infiltration and they need to find out where it is coming from. |

A warrant which would specify the federal, state, or local statue that the alleged criminal is violating, and the evidence that the police have lawfully attained to justify their suspicions. |

Like I stated previously the chances of them needing on your property would be rare, they are going to do a drive by and you won't even know they were there. IF for some reason you gave them a reason to feel a need for a further search of your property because you are infiltrating the system, then you can forbid them to enter your property then the police can get a search warrant. Personally a lot of extra BS, time & money into the system that your already paying for in your monthly bill and taxes. |
