You don't need a judge to sign a subpoena. If they do not respond, Taitz can file a motion to compel. If the motion is granted, the judge signs an order compelling production. Not sure if they can appeal that decision.

Discovery powers are sweeping, assuming Taitz has filed a proper complaint, rules are rules. How and why the defendants might get the case dismissed before discovery starts is the question. Releasing the certified "copy" has opened some legal doors to seeing the original, I think. But, the way the system works, and given that Obama has unlimited funds for lawyers, they could fight the subpoena for quite a while, and maybe quash it, but I doubt it. Their only hope to avoid producing the original is to get the case thrown out.
