I can't leave this week without my deposit I paid her...she is avoiding me, it seems, not returning my phone calls, etc...I do not have her address- only a phone number and it's her house phone- not a cell. I have a feeling she is going to cheat us out of this also- I had no vehicle most of this year, until recently- she never once offered me one ride, knowing my major health issues and pain... I know I could likely take her to small claims court, but I'd have to stay here to do it..nearly impossible...plus this house is musty and I've been plagued with monthly sinus infections, and the ceilings are starting to cave in...we have noticed the ceilings actually getting lower! She also left a HUGE, basketball-sized wasp/hornet nest right outside my back door! I told her my son got stung (only once, thank goodness) and she did NOTHING to remove it! She promised us a stove by Thanksgiving- that didn't happen either- we had burgers on the grill...this woman claims to be a Christian (I am a devout one) and yet she treats people like DIRT. Her son is a bigshot pastor here in Toledo at a very large church..I really need a reference from her, for my next landlord- credit is shot from many years of sickness after losing my good job fifteen years ago...what can I do to get my $$ back? Get a good lawyer to send her a letter detailing some of the items you mentioned here. It may be enough for her to set you free with some bucks in hand. |

Many states have renter's rights laws. requiring her to fix the range and such immediately. It usually covers deposits and such also. check them out. |

But she will call your bluff and not care. The government won't care either if you try to report her. You have no case since nothing is in writing saying you could get out of the lease early or get the deposit back. You are better off slowing down and waiting until you have the money to do this. |

If not done by the 30 days, many states default the judgement to the tenant. Hopefully you detailed your damage list with everything possible when you first moved in. Bottom line is it comes down to what you have on paper, that's all the courts really care about. Additionals might help, such as pictures and/or video of the "substandard" living environment. You need to get a certified letter to your landlord. This will show you attempted to contact them. Also get it notarized. I own my home in another state- I know how to take care of things- but part of the reason I rent is because I am sick and want to opt out of the responsibilities of owning your own home. Now your other idea, about contacting her son, the big Pastor, is worth a thought... but not to ask him for funds from them- SHE owes me the money- not them. |

In my state the landlord doesn't have to return deposit until 3 weeks after you move completely out. If you move out before lease is ended the deposit goes for lost rent, etc. You need legal advice to see if there is anything you can do. If you can't afford a lawyer many counties have a legal aid department free to residents. In my county it's at the court house in the law library. They will give you the information of what you need to do if you can do anything at all but they don't do it for you. At least it would be a place to start. |

Thank you for the ideas guys... Try contacting your local tax assessor's office. They pay property tax on the house and there should be a record of their mailing address for them to send tax notices. I tried to post a link to the tax assessor in Toledo, but it won't post. I hope all works out for you. |
