Civil rights suits tend to succeed only when the officer is a rogue operator, who abused the suspect in the course of an invalid arrest. If an officer arrests you without probable cause, because the officer was mistaken about the facts that he thought supported probable cause, in most situations you will have a very hard time suing the officer for damages. |

The heart of Sf is gone. I almost got arrested for calling a ruDE att park employee a bitch, then walking away. The cop kept telling me to calm down when I would calmly ask for my park ticket back. |

Also i am not a great fan of police in general. However this woman is plainly stupid in my opinion. So she gets pulled over for whatever reason The police 'may' just want to tell her she has a light out? Surely she must identify herself when asked. What is wrong with just being decent and speaking? So then the cop asks do you know why i have pulled you over. What harm is there in saying no i do not. If the cop then proceeds to tell you why and you want to be difficult or even protect yourself from saying 'the wrong thing' just say 'i do not want to answer'. Its still ok to be polite/ As for just sitting there and being rude like she was i think she deserves arresting. From the cops point of view who is she whats she hiding Look at it another way. Cop pulls over a real criminal, murderer, terrorist etc. but does not realise this yet. If all the perp has to do is sit there and say absolutely nothing and the cops will let him go then why have any cops at all. Ready and Waiting |

Prior to that, normal civil courtesy would have been appropriate. Quoting: Berf Snurple You don't have to say a damn word. As soon as they begin to question you they have already formed a reasonable suspicion that you were doing something illegal. Once you are lawfully detained you don't have to say crap, as it "WILL be used against you." |

No one has to wait until being arrested to exercise their right to remain silent. |

Up to and including large public executions for those willful infringers. |

She should have stayed consistent in her refusal to speak. Did she provide her license and registration? In many states, that is all you need to do "Be polite, be professional, be prepared to kill everyone you meet." What keeps you awake at night? "Nothing, I keep other people awake at night." There was one that would always race down RT 23 well over 100 mph and run all the traffic lights. I'm guessing he was the one screaming at me through his microphone for going through a yellow light. "ARE YOU IN A HURRY?!?! I CAN TICKET YOU FOR THE CRACK IN YOUR WINDOW!" |
