Besides that she was exercising her right to remain silent. They asked "Do you know why we pulled you over." How is that obstruction for not answering that question anyways? Answering that does not help them conduct their job. The police already know why they pulled her over.

Civil rights suits tend to succeed only when the officer is a rogue operator, who abused the suspect in the course of an invalid arrest.

If an officer arrests you without probable cause, because the officer was mistaken about the facts that he thought supported probable cause, in most situations you will have a very hard time suing the officer for damages.

The right to remain silent applied once she was under arrest. Prior to that, normal civil courtesy would have been appropriate.

Normally i don't take part in threads like this. Also i am not a great fan of police in general. However this woman is plainly stupid in my opinion.

If the cop then proceeds to tell you why and you want to be difficult or even protect yourself from saying 'the wrong thing' just say 'i do not want to answer'. Its still ok to be polite/

Look at it another way. Cop pulls over a real criminal, murderer, terrorist etc. but does not realise this yet. If all the perp has to do is sit there and say absolutely nothing and the cops will let him go then why have any cops at all.

You don't have to say a damn word. As soon as they begin to question you they have already formed a reasonable suspicion that you were doing something illegal. Once you are lawfully detained you don't have to say crap, as it "WILL be used against you."

Everyone has the right to remain silent at all times. No one is compelled to speak. That's why it's a right. No one has to wait until being arrested to exercise their right to remain silent.

It's my opinion and sincere hope that ordinary people begin to react to the trampling of their rights and freedoms with extreme violence towards those willfully doing the trampling. Up to and including large public executions for those willful infringers.

She should have stayed consistent in her refusal to speak. Did she provide her license and registration? In many states, that is all you need to do

State cops in Jersey are pure scum and can do whatever they want with no accountability. There was one that would always race down RT 23 well over 100 mph and run all the traffic lights. I'm guessing he was the one screaming at me through his microphone for going through a yellow light. "ARE YOU IN A HURRY?!?! I CAN TICKET YOU FOR THE CRACK IN YOUR WINDOW!"
