TRENTON — Two New Jersey state troopers cuffed a woman along a Warren County roadway and hauled her in on an obstruction charge because she refused to answer questions during a routine traffic stop, according to dashboard camera footage obtained by NJ Advance Media.

The October 16 incident, which happened near the New Jersey-Pennsylvania border on Route 519, is now the subject of a federal civil rights lawsuit filed by the woman, Rebecca Musarra, an attorney from Philadelphia.

Musarra claims in the suit the troopers violated basic rules familiar to anybody who's ever watched a police show on TV, including the right to remain silent.

She claims at least three troopers insisted during the ordeal that her refusal to answer questions was a criminal act.

Besides that she was exercising her right to remain silent. They asked "Do you know why we pulled you over." How is that obstruction for not answering that question anyways? Answering that does not help them conduct their job. The police already know why they pulled her over.

Civil rights suits tend to succeed only when the officer is a rogue operator, who abused the suspect in the course of an invalid arrest.

If an officer arrests you without probable cause, because the officer was mistaken about the facts that he thought supported probable cause, in most situations you will have a very hard time suing the officer for damages.

Normally i don't take part in threads like this. Also i am not a great fan of police in general. However this woman is plainly stupid in my opinion.

So she gets pulled over for whatever reason
The police 'may' just want to tell her she has a light out?

Surely she must identify herself when asked.

What is wrong with just being decent and speaking?

So then the cop asks do you know why i have pulled you over. What harm is there in saying no i do not.

If the cop then proceeds to tell you why and you want to be difficult or even protect yourself from saying 'the wrong thing' just say 'i do not want to answer'. Its still ok to be polite/

As for just sitting there and being rude like she was i think she deserves arresting. From the cops point of view who is she whats she hiding

Look at it another way. Cop pulls over a real criminal, murderer, terrorist etc. but does not realise this yet. If all the perp has to do is sit there and say absolutely nothing and the cops will let him go then why have any cops at all.

Everyone has the right to remain silent at all times. No one is compelled to speak. That's why it's a right. No one has to wait until being arrested to exercise their right to remain silent.

State cops in Jersey are pure scum and can do whatever they want with no accountability. There was one that would always race down RT 23 well over 100 mph and run all the traffic lights. I'm guessing he was the one screaming at me through his microphone for going through a yellow light. "ARE YOU IN A HURRY?!?! I CAN TICKET YOU FOR THE CRACK IN YOUR WINDOW!"
