I was a flight attendant for 36 years. I was very kind to passengers. I do not like to see anyone mishandled, and many passengers do not know what can happen to them if they act up. I feel badly for them. I had some smart-ass passengers, but never reported them unless they physically pushed me. That happened once...a female, and my witness was one of Vice President Gore's Secret Service agents. He gave me his card. She failed to comply with stowing her carry-on and pushed me. She was removed from the plane.

It isn't right BUT they do have the LEGAL RIGHT to refuse service.

In this instance, over capacity is definitely a reason to remove a passenger.

A ticket is a Contract. If money was accepted for it, it is a BINDING CONTRACT. The airline has accepted the responsibility to get you from point A to point B at the time - or reasonably close to it at the designated time and date - unless something happens outside of their control. That's their side of the contract to be fulfilled, after they took your money.
Reasonable, normal, civilized behavior is expected, but those are covered elsewhere.

The much quoted "rules" on back of the ticket - if a ticket is actually issued - are in fact a "Contract by Adhesion".
"Contract by Adhesion" is generally NOT ENFORCEABLE (and legally binding) if brought to Court in a lawsuit.

The huge problem with your argument is, that the airline has a LEGAL BINDING CONTRACT with the passenger (if the ticket is paid in full) to fly him on THIS flight to his destination, or at worst, on another plane at a NOT MUCH LATER time to his (contracted) destination. I believe, two hours is the maximum permissible time between flights.

The airline is, and was in a breach of contract, and enforced the breach, with violence.
I hope he sues, and sues for a LOT (and gets a LOT with some massive punitive damages to boot and for good measure).

Funny, when we employees fly, we're some of the best dressed people. I can sit in the gate area, look around, and guess who's flying stand-by/free.

I'm assuming the pass riders (women/girls/teens) wearing tight leggings and not covering their butts didn't care about the dress code. Once they covered up with a dress or skirt, they were permitted to board. The dress code is so much more relaxed than it used to be, so they must have looked really bad.

You are pretending like he would not get another flight or a full refund if he chose. Why?

He was asked to leave a privet plan buy the operators and thought he had a RIGHT to be there regardless of any reasoning.

It was very reasonable for him to get up and leave when asked... he only had a right to be upset and disgruntled he could even refuse their service in the future etc. But he had ZERO right to what he did and attempt to force himself on the plane.

where is the clause when you pay that they can remove your right for no reason but they overbooked.
if he was making a scene at the gate and pushed in ...maybe call the police.
if he did not have an assigned seat...ok

but none of this happened...

this guy is just sitting in his seat waiting to leave so he could return to his job as a doctor with patients waiting him in the morning.
this was their last flight out till the morning.

you would have seen me getting dragged off screaming why are you removing me?

there is no law that states and airline can remove a passenger for no other reason then they need your seat for there staff and they F'ed up and over booked.

No its about the law of contracts. Its NOT about private or public property. Please read earlier posts by AC with a Hungarian flag and my post about this case on the previous page.(correction p.12) The passenger had every right to refuse their demand. The airline was in breach of contract and they made matters worse for themselves by involving the police to enforce their illegal actions. The good dr's lawyers are going to have a field day in court

you do not fly much.....

yes they call it bumped off...but never removed once you are on the flight.

you will not be seated on the plane.

i have had to wait to board because of this.

this is ALWAYS settled BEFORE you board said plane.

this was FUBARed by the gate personnel.
they did not handle it professionally.

they do not have the right to remove any person because they have other at the gate who did not have an asigned seat.

the doctor had a ticket and an assigned seat...he was boarded and was sitting quietly.

again....if i was this man i would have not given my seat up after i went through everything and was sitting in my assigned seat.

now if i was coming home and had nothing the next day.....maybe i would have taken the $$$....but if i was traveling for work before the next flight...hell no i would not give up my PAID for seat.
