It's a 1917 Statute called the 'Trading with the Enemy Act', revised in 33 (which included US citizens, not just foreigners), and again in 77 (revised so they have to re-declare the emergency every 2 years). [link to www.treasury.gov (secure)] [link to www.law.cornell.edu (secure)] (1) During the time of war, the President may, through any agency that he may designate, and under such rules and regulations as he may prescribe, by means of instructions, licenses, or otherwise— (A) investigate, regulate, or prohibit, any transactions in foreign exchange, transfers of credit or payments between, by, through, or to any banking institution, and the importing, exporting, hoarding, melting, or earmarking of gold or silver coin or bullion, currency or securities, and (B) investigate, regulate, direct and compel, nullify, void, prevent or prohibit, any acquisition holding, withholding, use, transfer, withdrawal, transportation, importation or exportation of, or dealing in, or exercising any right, power, or privilege with respect to, or transactions involving, any property in which any foreign country or a national thereof has any interest. Everytime any president declares a 'national emergency', it grants them absolutely authority over all international & domestic commerce related to the emergency, because a 'state of emergency' is really a declaration of war powers. It's kind of funny that all of a sudden everyone is crying about it with Trump but didn't care for the past 100 years about their rights being thrown down the toilet. War on Drugs, War on Poverty, War on Terror, etc, etc? Yea, every president declares a 'national emergency' every few years to give themselves neverending war powers. |

No president has the power to order US companies to do anything. It was decided by the Supreme Court in 1952 that the president does not have this kind of power. That's when Truman attempted to control private steel companies using what you cited. [link to www.casebriefs.com (secure)] Truman lost. By a vote of 6 to 3, the justices sided with the steel companies. The “President’s power, if any, to issue the order must stem either from an act of Congress or from the Constitution itself,” Justice Hugo Black wrote in the majority opinion. |

That's a false equivalency. That case had nothing to do with a declaration of emergency or the use of the war powers. The judge ruled correctly since that wasn't the issue. The President has declared China involved with the Fentanyl trade, including it under his declaration of emergency. [link to www.nbcnews.com (secure)] Thus, it can be ruled that trade with that country be barred under the war powers. |

The judge in that case even admits that the president COULD HAVE used his emergency powers to stop the strikers, he didn't. THAT'S why the judge ruled it invalid. The government could have used the Taft-Hartley Act to declare a national emergency and forestall the union's strike, but the fault for the dispute seemed to lie more with the industry than the union. Anonymous Coward User ID: 44758796 United States 08/24/2019 07:21 PM Report Abusive Post Report Copyright Violation | Leaning further into a burgeoning economic war with China of his own design, Donald Trump on Friday levied a series of bizarre demands of American companies who do business in the country. Quoting: Anonymous Coward 72331502 They included an order for American firms to cease production in China. “Our great American companies are hereby ordered to immediately start looking for an alternative to China, including bringing your companies HOME and making your products in the USA.” The proclamation, which the president does not have the power to enforce, might have been expected to unleash a wave of panic and terror among America’s mostly capitalist citizenry – such state-mandated orders are, after all, the stuff of planned-economy communist countries. But instead, America’s Twitter-sphere resorted mainly to mocking Trump and his rhetorical flourishes. Soon “I hereby order” was taking on a life of its own: from top politicians down to the man-in-the-street Twitter inhabitant. Such as: "It's so cute he threw in "hereby" as if it means anything. "I hereby order the Cubs to win their next 20 games." "I hereby order the Stock Market to go up and our Great Economy to do even better!" In short, it was simply another weird day under the Trump administration, during a week in which he has already called himself “The Chosen One” and picked a fight with Denmark because of its refusal to consider selling him Greenland. It's a heads-up to US companies that this is going to get uglier. 2. It's a warning to china that our companies can find other suppliers. And with the help of the brain damaged media...every US business has received the message! Look at the tweet...Trump worded it very carefully! "LOOK AT" has no teeth...any company could say we have "LOOKED AT IT". If I am going to be damned...I am going to be damned for who I really am! |
