As per prior Supreme Court rulings, police are extremely limited in their ability to issue orders to the press. This also applies to citizen journalists, not just professionals. Anyone with a camera or camera phone would have been legally entitled to be doing what CNN was doing and police orders to the contrary would be deemed unconstitutional.

When there is a riot and police come up to you and tell you to move, you move. You don't ask questions when there is a riot. That is seen as challenging their authority and they won't tolerate it. You get far away from the cops as possible during a riot. Cops are definitely not going to be nice to you during a riot nor are they going to respect your rights either. Everyone and everything is seen a potential threat in the eyes of stressed out law enforcement during a riot.
