Two points:
1. Executive orders can only modify, not legislate. So Trump changed the sunset date to the future and lowered the amount contained in the original relief bill. This is why the EO was limited in scope and he said that they would be open to negotiating the other points in the failed new bill.

2. The Dems could take it to court, but they would look pretty bad denying money to people who really need it right now.
