Listen to this ^ I had 180k of unsecured college debt basically... forgotten about after they tried to collect for 7 years. The procedure is called "debt verification" and it means that you will request the paperwork with your original signature in ink. Not photocopy not digital signature... those mean nothing in court (how could they? its easily faked). This is essentially the scam a lot of indians and pakistanis run when they come to USA, max out credit cards, open 7/11. Go to court - refuse to pay until promissory agreement is provided by lander. No such thing exists - unless you did sign a paper when applying for credit card. There is will be a lot of phone calls from a lot of assholes trying to collect, but if you cease and desist them and use FDCPA as your protection - they can just send a letter. I had a 3 stage process - 3 letters. One nastier than the other. Picked it up from some british website around 2011. It was essentially (i summarize) Letter 1: "I'll pay everything back! Prove you own the loan by sending notarized copy of original promissory note!" Regardless of what they sent, step 2 Letter 2: "I have not received certified copy of original promissory note from you! Please send asap!" They might or might not send anything again. Irrelevant. Letter 3: "I believe you're trying to defraud me, cease and desist all communication, further contact will be billed at $1000 per hour it takes me to respond to you. By contacting me further you agree to this tacit agreement" Then if they call or send anything again send them bills for your time. I did this with 2 initial student lenders... also reported one of them to BBB for fraud. They immediately sold off the loans... and about 20 trash tier lenders later they gave up. I have perfect credit score and own a house now. If you're interested I can post the full letters. This can only be used on private loans with no ink signature. Federal student loans for example or loans with ink signature note - you can't do this on. |

If you don’t give a shit about your credit (worrying about credit in a country who just had their election stolen seems silly to me) then don’t pay them for I believe it is 4 months (can’t remember exactly might be 6 months) and after that they will call it a charge off and you can work out a plan to pay them a percentage of the total amount. It will screw up your credit but then they won’t take you to court or garnish your wages. Say if you owe them $5000 after 4-6 months they might take less than $1500 to pay off the debt in total. |

When I was dirt poor I cut shit like that off and went to the pawn shop bought $1 seasons of my fav shows and movies on rerun, then next paycheck I’d buy next months entertainment Oh and I was so poor I combed my hair with a fork and used a hammer and flathead screwdriver to open canned goods because I was saving every penny for rent so I wouldn’t get evicted If you don’t have the money don’t spend money. If you are bored or hungry .. too bad Was my philosophy Rent is #1 Mortgage you can probably make easier arrangements to not pay for a few months Rent you are out on the streets unless your landlord is nice |

Her name was not on the house or any assets. She walked away from 60,000 of debt, Bank of America was the biggest loser, my heart bleeds piss for BofA. Fuck all banks, they deserve to lose some of their ill gotten fiat currency. |
