OSHA Suspends Enforcement of Vaccine Mandate After Most Recent Court Ruling...

This gives companies who are not federal contractors or healthcare a reprieve.....but does nothing for businesses that are federal contractors or health care workers....that is going to have to be another lawsuit and another hearing

My company has sent emails for a month now that they would enforce Bidet's mandate. If it does become mandate again, I simply await dismissal and then ready to hop on any number of class action lawsuits. They must not win.

It will be the final ruling on this OSHA mandate issue that will cascade into all the pending lawsuits filed to stop federal employee and federal contractor mandates.

You know how the courts love precedent.

On November 12, 2021, the U.S. Court of Appeals for the Fifth Circuit granted a motion to stay OSHA's COVID-19 Vaccination and Testing Emergency Temporary Standard, published on November 5, 2021 (86 Fed. Reg. 61402) ("ETS"). The court ordered that OSHA "take no steps to implement or enforce" the ETS "until further court order." While OSHA remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation.

I agree, although we have a while before we'll know the final ruling.

The federal 'lottery' has already happened to decide which court will hear these cases, and the 6th Circuit Court was drawn. This means the 6th Circuit will bundle all lawsuits together and rule on them. Right now there is no estimated date when this ruling will take place.

Once the 6th Circuit weighs in, that can be appealed to the Supreme Court who then can choose to take the case or reject it. If rejected, the 6th Circuit's ruling will be the final say. If accepted, the SC's ruling will be the final say.

Either way we have a long ways to go here.

Kansas City Chiefs, NFL Football, played the Las Vegas Raiders last Sunday in Las Vegas. Someone who was there said that all fans entering the stadium were required to be vaccinated, so they were administering COVID vaccines in the parking lot!

I am about to as well. Very good paying job but they are pushing the mandate. They have the testing option but I am not doing that so I will be shitcanned.

The ruling on this is about as one-sided as you are gonna see against the OSHA mandate. It was a pretty resounding FJB in a nice, legal paper.

See what they did? They were very fucking cunning and evil once again. They knew they had no legal precedent to force this through, but the damage was done once they got all the big corporations to buy into the bullshit. How many millions of people have been compelled to vaccinate to retain their job now, or forced to quit/resign because of this? So now the big companies have their policies in place and won't change them. The ones that didn't budge won't budge now, but the damage was done. This is the same shit they used for the masks. Couldn't enforce it federally so they deferred to the companies to enforce it for them. The good news is that the testing bullshit will likely be gone for most companies. Biden and co used that "or" get tested weekly bullshit to ensure people couldn't opt out on exemption. Fucking pieces of shit.
