These weapons, which produce heat and fire through the chemical reaction of a flammable substance, cause excruciating burns and destroy homes and other civilian structures. They are regulated by Protocol III to the Convention on Conventional Weapons (CCW), but that instrument has loopholes that reduce its legal and normative power.[1] CCW states parties have increasingly expressed support for revisiting and strengthening Protocol III, and they have set aside time at their annual Meeting of States Parties in November 2018 to address the topic. Reality: While states should join and comply with the Convention on Conventional Weapons, Protocol III governing incendiary weapons has two loopholes that interfere with its ability to protect civilians. Article 1 of Protocol III narrowly defines an incendiary weapon as “any weapon or munition primarily designed to set fire to objects or cause burn injury to persons….” This definition excludes multipurpose munitions, notably those containing white phosphorus, which set fire and cause burns but are “primarily designed” for other uses, such as marking, obscuring, or signaling. Article 2’s restrictions on use arbitrarily differentiate between incendiary weapons based on their delivery system. Article 2 comprehensively prohibits the use of air-dropped incendiary weapons in concentrations of civilians, but it allows the use of ground-launched incendiary weapons in concentrations of civilians when the military target is “clearly separated from the concentration of civilians and all feasible precautions are taken” to limit the incendiary effects and minimize injury or loss of life to civilians. The drafters of Protocol III focused on regulating the incendiary weapons most troubling at the time of its negotiation: air-dropped weapons specifically designed to burn and set fires. However, the rockets are just as destructive. Recent news reports indicate Russia’s intention to modernize much of its military in the coming years. The commander of Russia’s Radiological, Chemical and Biological Defense (RChBD) troops, Maj. Gen. Eduard Cherkasov, announced a focus on so-called ‘flame weapons’ – incendiary, thermobaric and fuel-air explosive (FAE) weapons – describing a program of modernisation and development. “Flame weapons are very efficient in close combat and have not only physically destructive but also psychological effect on an enemy.” Arms and munitions using these principles are more prominent within Russian military doctrine compared with that of many western nations... ARES recently released Research Report No. 3 Raising Red Flags: An Examination of Arms & Munitions in the Ongoing Conflict in Ukraine, documents a number of ‘flame weapons’ of Soviet or Russian origin in eastern Ukraine, in service with both Ukrainian government forces and pro-Russian separatists. RPO-A and MRO-A thermobaric weapons which were produced in Russia relatively recently (2002 and 2008, respectively), have been documented in eastern Ukraine. Both ARES and VICE News have documented the presence of the 9M22S incendiary rocket in eastern Ukraine. The 122 mm 9M22S rocket carries the 9N510 warhead, containing 180 incendiary elements which are composed of ML-5 magnesium alloy and filled with a pyrotechnic composition similar to thermite. Each element has a burning time of at least 2 minutes. The 9M51 fuel-air explosive rocket has also been employed in eastern Ukraine. This 220 mm rocket is launched from the 9K57 Uragan MLRS and delivers the 30.2 kilogram 9N515 FAE warhead. This rocket is designed to engage infantry and light vehicles, and is particularly effective against targets in confined spaces. Reports suggest that the 9M51 rocket was employed by Ukrainian government forces to target pro-Russian separatist forces in Donetsk, Luhansk, and Makiivka. A note on definitions: thermobaric and FAE weapons are not typically considered ‘incendiary’ weapons by western militaries, as they are intended primarily to detonate rather than deflagrate, by way of a deflagration to detonation transition (DDT). Actually I do not think Russia has occupied any area that is predominantly Ukrainian. At the start the soviet troops invaded predominantly Ukrainian areas and were annihilated by the population almost instantly. When the US invaded Iraq they were actually more welcomed as liberators than the soviet troops that invaded Ukraine. MlCHAEL |
