It's 2am, and I literally just got up from playing a video game with my nephew on ps4. I heard a noise on the other side of the house, so I went to go check on it. I wrote it off as my turtle rearranging his shit and went into my bedroom where my wife was sleeping when I heard something at my window. It didn't take but five seconds or so for it to be clear this was someone taking the screen out. I grabbed the only gun I don't keep in a safe (five children) and woke my wife up. I told her to get on the floor between the bed and dresser, took a defensive position a couple of feet behind the window, and focused on controlling my breath. I wasn't breathing heavily, I just knew I was about to have to pull the trigger and wanted to get it right. The screen was out now and the window was creaking, so my mind was instantly made up; I'm shooting. I have to shoot. I thought about telling the guy I was there to begin with, but I didn't want to give up the huge advantage I had, plus, I live in FL; this would without a doubt be a textbook Castle Doctrine case. As I'm waiting, my wife is begging me to make sure it's not one of the kids. I knew it wasn't because I had just checked the house for the previous noise, but for some reason, it made me decide to announce that I was there, inches away and about to rush deliver him to the consequences of the worst decision he had made in his life. I shouted, "I'M ABOUT TO PUT SOME BIG HOLES IN YOU, MOTHERFUCKER!!!' and he shouted back that he was "Very sorry" slammed my window back shut from the foot or so he had it opened, and ran away between houses. I turned the flashlight on my Sig, and ran through my house checking the rooms, and then around the outside of my house while my wife dialed 911. Once outside, I realized that he had taken out three screens looking for an unlocked window, and mine was the only one he found. Now that it is over, and I have had a few days to process it, here is where my head is at: Words can't begin to describe how happy I am that I was armed and prepared for the situation, but I am even happier that I didn't have to take a life. If you come into my house at two in the morning, you will die, and had I caught him legit inside my house he would have, but I almost missed the chance to stop him BEFORE that happened. Of the thousand things running through my mind since, this is the one that is there the most. What are your thoughts GLP? Did I fuck up? Am I a pussy? I wasn't scared to shoot him, in fact, if not for my wife I most likely would have. I'm glad I didn't though. You did the right thing. It coulda been a 15 or 16 year old in the wrong house looking for a booty call....thats why he said sorry. Will we even know we were alive when we're dead? If you were a pussy you may have panicked and made the situation much worse. While you were prepared and able to counter any hostile move you wisely chose to warn off the other party before dire hostilities arose. I can't speak for how the law is defined and applied in the US in regard to this sort of situation but I can relate to it as applied in South Africa (while I was there. (IANAL)). In short it boils down to the level of percieved risk of physical harm to the person, and any other placed under his/her protection, at any given moment. In your case the risk never really rose much above zero. While the potential was high the actual risk at the any moment was low. Which is where the whole issue of 'Reasonable Force' comes into play. Had you shot through the closed window and killed someone you had not identified as a real physical threat, i.e. armed or beyond your ability to stop without deadly force, then you would be the probable criminal and the other party would be the probable victim. It's not 'reasonable' to kill or maim someone who posed no identifiable threat. Had he stormed through the window and actually gained entry and was now a real and immediate threat... then you were well placed to shoot and render him 'harmless'. However, once he is 'harmless' (and not actually dead - wounded, unconscious etc) the 'Reasonable Force' rules reapply. You did well. Many wouldn't |

I am glad you didn't shoot him, would have been too traumatic, and you may have always wondered, what if... This is why I check locks every night. My son, he will leave stuff open and forget, drives me NUTS. I have had many close calls and heard many stories. I was disabled for a while and bedridden. I lived in a 2nd story apartment in eastern San Diego, with my two small boys. One night, I had a friend visiting, she thought I was a goner and came to see me. It was very late, she was in my doorway, chatting with me, I was in the bed, all lights were out. She suddenly heard someone trying the front doorknob, to see if it was unlocked. Freaked us both out a bit. Another time, I woke up to find the screen to my sliding door on my second story balcony, had been opened. It was a hot time of year, and I had drilled a stop-lock into the top rail of the sliding door, so nobody could open it, and had it locked at about 4 inches open. Someone apparently took that gap as an "invitation". I knew a family once who told me that they had an intruder at night, and the father grabbed his gun, stood at the top of the stairs and cocked it. That sound alone made the person take a quick exit. Maybe if we cannot afford guns, we could just get replicas that sound real? That sound alone could scare someone off, lol. |

I have a nephew (adult nephew) on the other coast and don't get much time to talk to him, so we play video games together some nights. I am a web and graphic designer professionally, and on the side, so I am up late alot working on freelance stuff. It's not uncommon for me to be up at 2am. And with five kids, can you guess when I get a chance to play video games? The evening after they go to bed. 2. My eyes had plenty of time to adjust to the light. There was a good couple of minutes between getting off, hearing the first noise, investigating, then going to my room and hearing the last one. Don't give up your day job there, Sherlock. You did wonderful OP, only recommendation would be have the camera in wife's hand to snap a photo, I know that may have been impossible, but maybe a hope or glimmer of catching the criminal wouldn't have been lost.
