first and foremost ~ put shoes on. If you have time to get the guns you have time to put shoes on. kinda hard to stand your ground without shoes.

The problem with what they did was pointing the firearms at the protesters..

Every responsible firearm owner knows you CANNOT point your weapon at someone as a form of intimidation.

Had they stood there with their weapons slung or holstered and not pointed at the protesters the DA would have nothing on them.

Not a public street. In the below CNN video at the 0:37 mark -

I don't know if I would have been that composed to just show a rifle and pistol. In that situation, if you brandish a firearm, you use it. If that had happened around me, many people would be dead and wounded...

it is a universal right to protect yourself and what's yours.
this is always the first right aggresors try to deprive their victims of, . .then they remove the right to complain about it.
this is precisely what we are experiencing in u.s.a. and everywhere, . .
who is the perpetrator? when in the course of human events it becomes necessary for a people, . .etc. great words, . .time has come to exercise them. now or never more again.

It was their own street. Private property behind a private gate. The street was owned by the house owners. Not a public street. Call it a driveway if you like.
 Quoting: Xeven

No, the street is owned and maintained by the community / HOA.

Those people do NOT own the street.
 Quoting: ^TrInItY^

If they pay HOA fees...they have partial private ownership.

Regardless, you don’t have to be on private property to protect yourself from a violent mob when they are threatening you.

If this happened out in the public park, they don’t have the right to protect themselves?

Meanwhile, CHOP idjets we’re running around the public street with guns and intimidating anyone who came within 2ft of their borders

Only one side seems to be immune to the law, and since our side wont stand the fuck up, it will stay that way.
At the end of the day, if we are going to continue to act within the law, we better keep our discussions realistically framed within it I suppose.

The thing the lefty marxist dear ones do is declare the obvious and easily understood by all to be too difficult to follow then start with endless legal theories that allow any and everything to bypass the clear and obvious with the convoluted, Byzantine and endlessly complex and ill defined that allow the system to prey upon the deep pockets citizen.
This endless bullshit would end before it started by recognizing obvious to all property and individual privacy rights, but confusing it with rights to protest turns it into a nightmare designed to extort every individual right from those that earned it, and strip them of all property.

Their weapon management was legal. Where do you get your info?

Homeowner: Your Honor and the Jury. An angry mob violently broke down the gate to our private community. This mob is of an organization who has been attacking and beating people on the street, dragging people from their cars and beating them, burning buildings, rioting and looting, calling for killing people etc ... all over the country. After they broke down the gate and advanced on our property I saw at least one armed and they were yelling about killing us. At that point I absolutely feared for my life and I drew my weapon.

After I drew my weapon they stopped advancing so I reassessed and decided the immediate threat was over, so I decided not to shoot.

Lawyer: ...... BS about the law and brandishing.

Homeowner: WOULD YOU HAVE PREFERRED I SHOOT A BUNCH OF BLACK PEOPLE AFTER THE SITUATION CHANGED? WHY DO YOU WANT ME TO SHOOT THEM?

These stupid branding laws need to change. The police and government use firearms for intimidation every day. Every day. But you go to jail.

“When you look at St. Louis with two people that came out — they were going to be beat up badly, if they were lucky — okay — if they were lucky. They were going to be beat up badly and the house was going to be totally ransacked and probably burned down like they tried to burn down churches. And these people were standing there, never used it, and they were legal, the weapons, and now I understand somebody local — they want to prosecute these people. It’s a disgrace.”

wouldn't they just need to provide evidence that the protesters had bad intentions?

I don't see any difference between this or ol'lady shooting her 44 magnum at a burglar is her house.
 Quoting: QCluminati

Prosecuting them is wrong, but they DO desperately need training. They clearly have none, and I have no patience for anyone who has the money to buy expensive weapons, but get no training. Watching movies ain't enough.

And btw, she didn't have a .44 Mag. The lady had a small auto, probably a .380.

Exactly. The protestors were not on a public street. They were on private property. It would be akin to violent trespassers threatening to kill residents on the driveway of their home's property / front lawn. No matter the outcome, legally it will be viewed as such. In Missouri, my understanding is that a person's home (castle law) extends to their front lawn.

Right. The mob had no defense. They were clearly on private property. There is no public street outside the house, it was all gated. No streets maintained by the city, county or state.

The "protesters" had clearly destroyed the marked gate in order to gain access to private property. Imagine you and your kids were at the pool at your condo and some scumbags broke the gate in order to walk around the pool, telling you and your kids they were going to drown you.

That's the same thing as went on in St. Louis.

In Florida you cannot use deadly force unless you fear for your life or you're attempting to stop a forceable felony in progress.

Each state is different but mostly it goes like that everywhere.
 Quoting: ^TrInItY^

It's Missouri - I've posted links and text from the law there - this was justified use of force.
 Quoting: PureSnow

The link quoted law regarding Peace Officers and Public Defenders.

I’m not trying to quibble but and I’ve said it before: you as a firearm owner need to be more knowledgeable of the law regarding self defense and lethal force than an attorney because the law is written to screw you. Full of if’s and may’s and shall and must. Those are legal technicalities and those will be used to put you in a legal trick bag.

My question seeing as you live in Missouri is: what constitutes a public defender? Is that a citizen? My understanding of the term: public defender constitutes an officer of the court(I.e. lawyer).

My $.02 on this is they’re screwed. They were brandishing firearms pure and simple. On a cursory search of Missouri law regarding lethal force is that it cannot be used in defense of property. The same website you linked to said there was case law to support that. However, in a following paragraph said it was legal. Hence the grey area supporting my statement of you better know you’re shit better than an attorney because not doing so leaves you holding the bag.

[link to statelaws.findlaw.com (secure)]

Quote from website: However, case law suggests it does not go so far as permitting the use of deadly force to merely protect property. In 2016, the Missouri Court of Appeals for the Eastern District held in State v. Whipple that deadly force under the castle doctrine can only be used when you reasonably believe such force is necessary to protect yourself or someone else from "the use or imminent use of unlawful force."

My interpretation of the above is person not property. Your view may be different and I welcome further discussion.

However this turns out it will be interesting to see because it will set case precedent.
